Terms of Service
By creating an account or using Eziria you agree to these terms and to our Privacy Policy. If you use the service for a company, you confirm you can bind that company.
1. What the service is
Eziria builds and hosts a website for your business, collects leads and orders for you, gives you AI tools to write and change the site, and, when you connect an advertising account, creates and manages ad campaigns on your behalf. Some features are automated and run on a schedule; you can review and change what they do from your dashboard.
2. Your account
- You must be at least 18 and able to form a contract.
- Keep your sign-in details private. You are responsible for what happens under your account.
- Give us accurate business information. Payment providers and ad platforms rely on it.
3. Credits and fees
- Credits pay for AI work (writing, edits, image generation and similar). Each action shows an estimate before you run it; you are charged the amount the action actually used, rounded up to the next credit. Credits included with a plan reset each billing period with a limited rollover shown in your plan; purchased credits do not expire while your account is open. Credits are not cash and cannot be transferred or refunded except where the law requires.
- Platform fee: when a visitor buys from your site, we keep 2% of the payment as our fee. Stripe’s processing fees are separate and are charged by Stripe.
- Ad management fee: if you turn on managed advertising, we charge the flat fee shown when you enable it, in addition to the ad spend you pay the ad platform directly.
- Plans: subscription prices, what they include and renewal terms are shown at checkout. You can cancel any time; the plan stays active until the end of the period you paid for.
- Prices and the credit rate may change. We will give notice before a change applies to an existing plan.
4. Payments and payouts
Payments on your site are processed by Stripe through a Stripe account connected to Eziria. By connecting, you agree to the Stripe Connected Account Agreement and Stripe’s terms. You are the merchant of record for what you sell; you are responsible for your products, delivery, refunds, taxes and compliance with consumer law. Stripe may hold or reverse funds under its own rules, and we may do so where fraud or abuse is suspected.
5. Your content and your site
- You own the text, images and other content you add to your site. You give us the right to host, copy, display and process it as needed to run the service and the AI features.
- AI-generated text and images we create for you are yours to use for your business, to the extent the law allows. The same or similar output may be produced for other customers.
- Unless you turn it off under Connections > Your data, you allow us to keep anonymized copies of your ratings and of text you rewrite by hand, with names, emails, phone numbers and links removed, as examples that improve the AI for all customers. We never show your sites, leads, orders or files to other customers.
- Stock photos come from Unsplash under its license; attribution is shown in your site footer. Keep it there.
- You are responsible for having the rights to anything you upload and for what your site says and sells.
- Your site lives on an eziria.com subdomain unless you connect a custom domain. Subdomains are not transferable and we may reclaim one that is unused or infringing.
6. Acceptable use
Do not use Eziria to:
- sell anything illegal, counterfeit, or prohibited by Stripe or the ad platforms you connect;
- mislead visitors, send spam, or collect data you have no right to collect;
- publish content that is hateful, sexual, violent, or infringes someone’s rights;
- attack, overload, scrape or reverse engineer the service, or resell it.
We may remove content, pause automations, or suspend accounts that break these rules, and we may do so without notice where needed to protect others.
7. Connected accounts and automation
When you connect an account (Stripe, Meta, Google or others), you authorize us to act on it within the permissions you grant, including creating and changing ad campaigns and spending the budgets you set. You can review everything we do from your dashboard and disconnect at any time. You remain responsible for complying with each platform’s terms and advertising policies and for the ad spend charged by those platforms.
8. No guarantee of results
Building a business is uncertain. We do not promise sales, leads, ad performance, rankings or income, and nothing in the product is financial, legal or tax advice. AI output can be wrong; review it before you rely on it.
9. Disclaimers and limits
The service is provided as is. To the fullest extent the law allows, we disclaim all warranties, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages, lost profits, or data loss. Some places do not allow these limits; where that is the case they apply as far as permitted.
10. Indemnity
You agree to cover us against claims arising from your site, your products, your content, or your breach of these terms, including reasonable legal costs.
11. Ending the agreement
You can close your account at any time from your dashboard or by emailing us; see the data deletion page. We can end or suspend the service for breach, non-payment, legal risk, or if we stop offering it, with notice where reasonable. Sections that by their nature should survive (payments owed, content rights, limits of liability) survive termination.
12. Changes to these terms
We may update these terms. We will post the new version here and update the effective date, and for material changes we will email you. Continued use after the change means you accept it.
13. Governing law
These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law rules. Disputes will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
